TERMS AND CONDITIONS OF NICOTINE POINT

  1. DEFINITIONS

1.1 "Buyer" means any person who buys or attempts to buy goods from the Seller;

1.2 "Seller" means “NICOTINE POINT” carrying out business through e-commerce, located at 18-8-233/69/2, Santosh Nagar Riyasat Nagar, Hyderabad 500059 Telangana India. 

1.3 "Goods"  and “products” are used interchangeably in this document and are limited to mean only the articles the Seller has already listed on the NICOTINE POINT website which is subject to regular changes in accordance with the supply of the seller. 

1.4 "List Price" means the list of prices of the Goods maintained by the Seller as amended from time to time;

1.5 "Terms and Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller. 

1.6 “website” means and is only limited to the website established by the seller by the name of “snusworld.in".

 

  1. GENERAL CLAUSES 

2.1 These Terms and Conditions, along with privacy policy or other terms (“Terms”) constitute a binding agreement by and between NICOTINE POINT, ( “Website Owner” or “we” or “us” or “our”) and the buyer (“you” or “your” or “consumer”) and relate to your use of our website and goods (as applicable). 

2.2 These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from any of the parties unless otherwise agreed expressly through writing. 

2.3 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods under these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason without justification and reserves the right to sell in accordance with its own will and accord. 

2.4 Acceptance of sales and/or subsequently order confirmation provided from the seller to the buyer and/or invoice of the Goods provided by the seller to the buyer shall be deemed conclusive evidence of the Buyer's acceptance of these Terms and Conditions.

2.5 These Terms and Conditions are available on request by email from the Seller or can be viewed online at snusworld.in. The Seller reserves the right to amend the Terms and Conditions from time to time.

2.6 Nothing in these Terms and Conditions shall affect the Buyer's statutory rights as a Consumer.

 

  1. PRODUCT INFORMATION AND DESCRIPTION 

3.1 Any description given or applied to the Goods is given by way of identification only and the use of such description shall not constitute a sale by description. For the avoidance of doubt, the Buyer hereby affirms that it does not in any way rely on any description when entering into the contract.

3.2 The seller will list the following details and specifications of the products on the website

  1. Product Name 
  2. Product Description 
  3. Product Flavor 
  4. Product Strength 
  5. Manufacturing Company Name

3.3 The seller displays the details and specifications regarding the products on the website in consonance with (clause 3.2) only to the extent that the suppliers of the seller have provided. 

3.4 The seller is not responsible for any loss, or damages occurring out of either lack of product details and specifications of the products or misrepresentation of details and specifications of the products. 

3.5 The Seller reserves the right to alter prices or withdraw and modify products from time to time per the sellers own will and accord and is not obligated to provide any justifications nor is it compelled to compensate for any damages or losses to the buyer or any other third party unless otherwise agreed expressly through writing. 

3.6 Products illustrated in all of the Seller's websites are done so as accurately as modern reproduction methods will allow. It is the responsibility of the buyer to check the desired product specifications before purchasing.

 

  1. PRICE AND PAYMENT 

4.1 The price listed by the seller is the final price quoted by the seller and is not subject to any changes or further negotiation by the buyer or any of the buyers representatives unless provided by the seller’s website on account of any ongoing discounts or store offers which are only available for a limited period which is up to the sellers discretion. 

4.2 The price of the Goods shall be that stipulated in the Seller's current List Price/on the Seller's website/as contained in the Seller's Quotation (as applicable) at the date of order. 

4.3 The price is in INR (Indian Rupees) and is exclusive of GST both state and central. 

4.4 The seller is entitled to accept only the stipulated forms of payment and other forms of payment not displayed on the website will not be accepted including but not limited to cryptocurrencies and alternate currencies of different jurisdictions.

4.5 Payment of the total purchase price (including GST and any delivery charges) must be made in full by the buyer or any representatives of the buyer before the dispatch of the goods by the seller. 

 

  1. HEALTH AND CONSUMPTION 

5.1 All purchasers or consumers must meet the minimum age requirement of 18 years, in strict compliance with the applicable laws governing the sale and consumption of nicotine products in India.

5.2 The Seller disclaims and absolves itself of all liability for any and all claims, losses, liabilities, or damages arising directly or indirectly from the consumption or use of the product, including but not limited to physical pain, health complications, addiction, or any harm to mind and body. This disclaimer applies to individuals who meet the applicable age criteria as well as those who do not.

5.3 By making a purchase, the Buyer expressly consents and acknowledges that the use of the product may result in various health complications, including but not limited to heart disorders, cardiovascular diseases, respiratory issues, nervous system disorders, anxiety, depression, gastrointestinal problems, immune system suppression, reproductive issues, liver or kidney damage, and other related or unforeseen conditions.

 

  1. DELIVERY AND SHIPPING SERVICES 

6.1 Unless otherwise agreed in writing, delivery of the Goods shall take place at the address specified by the Buyer within the timescale specified by the Seller.

6.2 Delivery is conducted using a third-party courier, third-party carrier, or any other third-party delivery service within India. 

6.3 The delivery period specified by the Seller is only an estimate provided by third-party delivery services and shall not be of the essence of the contract.

6.4 Delivery times vary according to the discretion of different delivery service organizations and the Seller shall use its reasonable methods to meet any stated delivery period or booked delivery date. In any event, the time of the delivery period or delivery booking shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery period or date. 

6.5 Any and all claims, losses, liabilities, or damages arising directly or indirectly from any alteration, delay, or change in the delivery schedule shall be solely addressed and resolved with the delivery service provider, and the Company shall bear no responsibility or liability for such occurrences.

6.6 All deliveries conducted by third-party enterprises will be booked after confirmation of the order and the Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. If the buyer is not available to take a pre-booked delivery, additional delivery charges will apply for the redelivery of goods. 

6.7 Title and risk in the Goods shall pass to the Buyer upon delivery of the Goods.

 

  1. No Refund and No Return

  1. LIMITATION OF LIABILITY 

8.1 The seller discloses that the products listed on the website are not manufactured by the seller and the seller is merely a distributor of the goods and is therefore not liable for any form of injury, including but not limited to personal injury to the body, injury to the mind, addiction, or any other injuries or mishaps that may occur to a consumer by the consumption of this product due to any defects occurring through production that may arise in the due course of consumption of the product.

8.2 The Seller shall not be liable for any direct loss or damage suffered by the Buyer howsoever caused, as a result of any negligence, breach of contract or otherwise in excess of the price of the Goods.

8.3 The Seller shall not be liable under any circumstances to the Buyer or any third party for any indirect or consequential loss of profit, consequential or other economic loss suffered by the Buyer howsoever caused, as a result of any negligence, breach of contract, misrepresentation or otherwise.

 

  1. FORCE MAJEURE 

9.1 Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lockouts, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.

 

  1. SEVERANCE 

10.1 If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.

 

  1. INTELLECTUAL PROPERTY AND COPYRIGHTS 

11.1 The Buyer acknowledges and agrees that all copyright, trademarks and all other intellectual property rights in all the Seller's literature and websites shall remain at all times vested in the Seller. The Buyer is permitted to use this material only as expressly authorized by the Seller.

11.2 The Buyer agrees not to (and agrees not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

 

  1. WEBSITE USE AND LINKS 

12.1 Access to and use of the Seller's websites are subject to these Terms and Conditions. The Buyer agrees that the use of these website services is entirely at the risk of the Buyer.

12.2 By using the Sellers websites the Buyer agrees not to attempt to undermine the website's functionality and integrity

12.3 The Seller's websites may include links to third-party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and the Buyer acknowledges and agrees that the Seller is not responsible for the content or availability of any such sites.

 

  1. GOVERNING LAW AND JURISDICTION 

13.1 These Terms and Conditions shall be governed by and construed in accordance with the law of India and the parties hereby submit to the exclusive jurisdiction of any competent court within the jurisdiction of India.
